Terms of Service

1. Acceptance of Terms

By accessing or using the aiMagicFish service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Eligibility and Authority

To use this Service, you must:

  • Be at least 18 years of age
  • Have legal authority to consent on behalf of any minors depicted in photographs
  • Have explicit permission from any adults whose photographs you submit, or be the individual yourself
  • Provide accurate and truthful information

For photographs of minors (under 18): By submitting photographs of minors, you represent and warrant that you are the parent or legal guardian of the minor(s) depicted, and that you have the legal authority to consent to the collection and processing of their personal information and likeness.

3. Service Description

aiMagicFish provides:

  • AI-generated personalized storybooks featuring characters based on your photographs
  • Digital download of the completed storybook
  • Optional physical printed book (via third-party printing service)

AI Disclosure: The character artwork in your storybook is generated using artificial intelligence. While we strive for quality results, AI-generated images may not perfectly replicate the likeness of the individuals in your photographs. Results may vary.

4. License Grant and Intellectual Property

4.1 Your Grant to Us

By uploading photographs, you grant us a limited, non-exclusive, royalty-free license to:

  • Process the photographs using AI to create character artwork
  • Include the generated artwork in your personalized storybook
  • Store the photographs temporarily for processing (deleted immediately after, or within 7 days if abandoned)

This license terminates automatically when we delete your photographs after processing.

4.2 Your Rights to the Product

Upon purchase, you receive a personal, non-commercial license to:

  • Download and keep digital copies of your storybook
  • Print copies for personal use
  • Share with family and friends as gifts

You may NOT resell, redistribute commercially, or use the storybook for advertising without our written permission.

4.3 Our Intellectual Property

The story text, templates, and underlying AI systems remain our intellectual property. The generated artwork is a derivative work based on your photographs and our AI systems.

5. Acceptable Use

You agree NOT to:

  • Upload photographs without proper consent from all depicted individuals
  • Upload photographs that are illegal, obscene, or harmful
  • Upload photographs of individuals who have not consented
  • Misrepresent your relationship to depicted minors
  • Use the Service for any illegal purpose
  • Attempt to reverse-engineer our AI systems
  • Upload photographs for purposes other than creating a personalized storybook

6. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT:

  • The AI-generated artwork will perfectly match photograph subjects
  • The Service will be uninterrupted or error-free
  • Results will meet your specific expectations

AI image generation technology has inherent limitations. Character likenesses are stylized interpretations, not photorealistic reproductions.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE.

8. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from:

  • Your breach of these Terms
  • Your upload of photographs without proper consent
  • Your misrepresentation of authority over depicted individuals
  • Any third-party claims related to photographs you uploaded

9. Termination

We may terminate or suspend your access to the Service immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Service will cease immediately.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the new Terms on this page. Your continued use of the Service after changes constitutes acceptance of the new Terms.
